1. Introduction. Child Alert System, LLC, a Virginia limited liability company (“Child Alert System”), is committed to respecting and protecting the privacy of each user of this Site. This Privacy Policy Statement (this “Privacy Policy”) is issued by Child Alert System in conjunction with the Terms of Service (“Terms of Service”) governing each user’s use of this Site and the Service. This Privacy Policy explains under what circumstances Child Alert System (sometimes referred to in this Privacy Policy as “we,” “us,” or “our”) gathers information relating to each user of this Site (referred to in this Privacy Policy as “you” or “your”), how we use such information, and who may access that information. This Privacy Policy is an integral part of the Terms of Service. All defined terms used in this Privacy Policy that are not otherwise defined shall have the meanings ascribed thereto in the Terms of Service.

This Privacy Policy may be revised by us periodically. We advise that you review this Privacy Policy whenever you visit this Site so that you are aware of any changes. 2. Collection of Personal Information. As fully explained in in the Terms of Service, the primary methods through which we may collect personal information concerning you and your children is through your establishment of a User Account and the establishment of your Profile for your children. You are under no obligation to create a User Account or a Profile, and you may access and browse this Site without creating a User Account or a Profile.

The specific personally identifiable information that we collect in connection with the account registration process (“Registration Information”) includes your name, address, telephone number, e-mail address, and Credit Card Information, including your credit card number and billing address. During the registration process, we may also collect other information from which your identity is discernible.

When you establish a Profile, you provide specific personally identifiable information concerning each of your children who you elect to include in each respective Profile. This information (collectively, “Child Information”) includes (a) basic identifiable information, including your child’s name, gender, and age; (b) physical information, including height, weight, hair color, and eye color; (c) basic medical information, including food and drug allergies; (iv) information concerning the school attended by your child; (d) popular places and locations where your child may frequent, such as a friend’s house or public park; and (e) in appropriate cases, information relating to the disappearance of your child. You may also post photographs or images of each child included within your Profile (collectively, “Child Photographs”).

 

The specific information elements that we make available concerning each of your children are designed to assist you and law enforcement authorities in the event that your child goes missing. While we believe that this information will assist in helping you and law enforcement authorities in the event that your child goes missing, you are under no obligation to provide any information concerning your children, and you may elect not to provide certain information that is requested.

 

If you do provide any Registration Information and Child Information, you are thereby consenting to the use and disclosure of such Registration Information and Child Information in accordance with the terms and conditions of the Terms of Service and this Privacy Policy.

3. Our Use and Sharing of Your Personal Information and Child Information.

a. Personal Information. Child Alert System will only use your Registration Information and Credit Card Information (collectively, “Personal Information”) as is reasonably necessary in connection with the operation and maintenance of this Site and the Services, and the establishment and maintenance of your User Account and Profile. We may also use your Personal Information to contact you with information relating to this Site, your User Account and Profile, or the Service. We are committed to protecting your privacy and we will not sell or lease your Personal Information to any third party.

Although we will make all reasonable efforts to preserve your privacy, in addition to disclosing and using your Personal Information in the manner described above, we may disclose your Personal Information:

i. to financial institutions and other service providers as is reasonably necessary to verify your Credit Card Information and to bill your credit card for your Profile or other services or products ordered at this site;

ii. to comply with any legal requirements or court orders, to defend any legal or administrative proceedings, or as we believe in good faith is necessary to comply with any laws or legal requirements;

iii. to protect any individual’s personal safety in an emergency situation;

iv. to protect or defend our rights or property (including enforcement of our rights under the Terms of Service); and

v. in connection with the sale of the equity or any of the assets of Child Alert System, in which case we will require the buyer to maintain the confidentiality of your personal information in accordance with the terms of this Privacy Policy.

Except as described in this Privacy Policy, we will not disclose your Personal Information outside of Child Alert System and its affiliates without your consent. We may share aggregated demographic and statistical information with our business partners. This is not linked to any personal information that can identify any individual person or child.

b. Child Information. Except as expressly consented to by you, as described in Section 4 below, Child Alert System will not share or disclose any Child Information that you may create in your respective Profiles without your prior consent except in the following limited cases: (1) to comply with any legal requirements or court orders, to defend any legal or administrative proceedings, or as we believe in good faith is necessary to comply with any laws or legal requirements; and (2) to protect any individual’s personal safety in an emergency situation. In such cases, Child Alert System will seek to give you advance notice of any disclosure and will exercise all reasonable precautions to limit the extent of any such disclosures.

4. Use by Other Parties of Your Personal Information. Your Personal Information may be accessed at the Site by any person who has access to your Login Information. As described in the Terms of Service, you should carefully protect the security and integrity of your Login Information to guard against unauthorized access and disclosure of your Login Information.

Child Alert System anticipates that this Site may, in the near future, enable (a) you to directly, or authorize Child Alert System on your behalf, to transmit your Profile to law enforcement officials and other appropriate parties in the event that your child goes missing; and (b) with your prior approval, law enforcement and public officials to directly access your Profile at this Site in the event your child goes missing. If you authorize such disclosure or access of your Child Information, you understand that Child Alert System cannot control how any third-party who receives or accesses your Child Information may use such Child Information, and that such Child Information may be used by third parties in violation of the terms of this Privacy Policy, and, potentially for improper or unlawful purposes. By authorizing the disclosure of your Child Information to third parties, you understand and agree that Child Alert System has no responsibility for the disclosure and use of such Child Information by such third parties, or by any person or entity to whom they may disclose any Child Information.

If your child goes missing, this Site contains a feature that allows you to post your Profile on a “Currently Missing” section of this Site (the “Currently Missing Page”). The Currently Missing Page can be freely accessed without restriction by any visitor to this Site. We are not responsible for the use or disclosure of your Child Information by third parties if you elect to post your Profile or any Child Information on the Currently Missing Page. We cannot control how third parties who can access your Child Information on the Currently Missing Page may use your Child Information and we have no means of tracking any use or disclosure of your Child Information by any such third party. By authorizing the disclosure of your Child Information to third parties by posting your Child Information at the Currently Missing Page, you understand and agree that Child Alert System has no responsibility or liability for the disclosure and use of such Child Information by third parties who may access the Currently Missing Page, or by any person or entity to whom they may disclose such Child Information.

5. Security. For payments of applicable fees to establish a Profile and purchase other services and products available at this Site, this Site uses a Secure Socket Layer (SSL) server which encrypts your personally identifiable data prior to transmission of this information over the Internet. We have also put in place reasonable physical measures and administrative procedures to safeguard against unauthorized access of Personal Information and to help prevent the loss, misuse or alteration of all Personal Information that we collect through this Site. We cannot guarantee that the security measures we implement in connection with the operation of this Site will absolutely prevent others from accessing or acquiring any Personal Information you provide while using this Site, including any Child Information contained within your Profile. You can do some things to help further protect the security of your information. For instance, remember to close your browser window when you finish visiting this Site, so that other people using the same computer will not have access to your information, and never share your credit card details or billing information with others.

6. E-mail Communications. From time to time, we may e-mail you news bulletins, information on technical service issues, or information relating to this Site, your User Account or Profile, and/or other aspects of the Service. You consent to the delivery of such communications by e-mail to the e-mail address(es) that you provide to Child Alert System when establishing your User Account. You may stop the delivery of future promotional e-mails from us by following the specific instructions in the e-mail you receive from the Company.

7. IP Address, Clickstream data and Cookies. In addition to the Personal Information you provide to us, we also collect certain, anonymous information as you access and navigate this Site. We collect this information to have a better understanding of how people use this Site, to analyze data for trends and statistics, to help diagnose problems with our server, to enhance the performance of this Site and to tailor your experience on this Site. Whenever you log onto the Internet, an Internet Protocol (IP) address is assigned to your computer by your Internet service provider. When you visit this Site we automatically collect and store the IP address of your computer, the Internet address of the site from which you linked to this Site (known as the referring URL), the date and time you access to this Site, and the type of browser you use. This clickstream data is not personally identifiable and we do not link this information to personally identifiable data. Clickstream data also shows us what pages of this Site you visit and in what order.

 

We also use session cookies. A session cookie is a small text file placed on your browser that maintains information from page to page as you navigate this Site. Session cookies are automatically deleted when you close your browser.

9. Access to and Change of Personal Information. At any time, you may access your User Account and Profile to amend your Personal Information. In addition, you have the right to contact us at any time to: (a) request the removal of any Personal Information that you provided to us from our servers and computer networks; and (b) update and modify your Personal Information. If any Personal Information is removed from our servers or computer networks, third parties who had access to such Personal Information prior to its removal may have retained some or all of such Personal Information. We are not responsible for the retention or use by third parties of any of your Personal Information at any time, including following its removal from our servers or computer networks.

10. Children’s Privacy. This Site is designed and intended for use only by individuals who are at least eighteen (18) years old. We are committed to protecting the privacy of children and we do not collect any personally identifiable information from children we actually know are under the age of 13. To ensure compliance with the Children’s Online Privacy Protection Act (COPPA), we will not intentionally or knowingly collect any personal information from any individual who is not at least eighteen (18) years old.
